The Delhi High Court has issued a notice in a case filed by Bollywood actor Karisma Kapoor’s children, who are seeking their share in the assets of their father, businessman Sunjay Kapur.
The petition has been filed by Samaira and Kiaan Raj Kapur, the two children from Karisma’s marriage with Sunjay. They have approached the court claiming rights in assets worth around ₹30,000 allegedly belonging to their father.
During the hearing, the court directed Sunjay Kapur’s wife, Priya Sachdeva, to submit a detailed list of all movable and immovable properties in his name. The matter has now been posted for further hearing after the filing of the asset details.
Priya Sachdeva counters children’s petition
Priya’s counsel argued that Karisma’s children, Samaira (20) and Kiaan Raj (15), had already been beneficiaries of the R.K. Family Trust and received a staggering ₹1,900 crore. “All this crying and weeping that is going on, just six days before the suit, the plaintiffs received Rs 1900 crore from the trust. What more do they want?” her lawyer questioned, adding that the children were far from being left in hardship.
The siblings have approached the court challenging the authenticity of Sunjay’s will, alleging that it had been fabricated by Priya to consolidate control over his properties and assets.
Will Dispute and court directions
During the hearing, Justice Jyoti Singh asked whether the will in question had been registered. Priya’s counsel clarified: “It’s not registered. Unregistered does not take the nature away. There is a judgment which says an unregistered does not take the validity away. When I set up the will, my lady will be entitled to examine if it is suspicious in nature.”
After hearing submissions, the court formally registered the plaint filed by Samaira and Kiaan. It also directed Priya to submit a comprehensive list of Sunjay’s movable and immovable properties as of June 12, the date of his death. The matter is now listed for October 9.
Counsel mentions Karisma divorce, family rift
Priya’s counsel also brought up the actor’s divorce from Sunjay, which was finalized in 2016 after years of litigation. “There were litigations after litigation it ultimately culminated in bitter divorce process which ended in SC. Please have some sympathy for the soul of the deceased. I (Priya) have a 6-year-old child. I am a widow. I am his last wife. You (Karisma) were nowhere to be seen for the last 15 years. It’s not as if these people are left on the streets,” the counsel told the court.
Sunjay’s mother also challenges the will
In a dramatic twist, Sunjay’s mother, Rani Kapur, also contested the will, claiming she had been completely excluded. “Today, I have nothing. I have written at least 15 emails asking about the will, what are the documents? Not a word has been shared. I have been told that my emails have been compromised. There is something incredibly unholy. Rs 10,000 crore worth of assets should have been mine. I am 80-year-old. Mother, her vested interest goes into trust. All gone. I am nowhere. Ms Sachdeva (Priya) comes in, within three months of her getting married, everything goes? My son today leaves me with not a roof on my head,” her counsel argued.
Allegations of forgery
The plaint filed by Karisma’s children claims that Sunjay never spoke of leaving behind a will, nor did Priya or anyone else ever mention its existence during his lifetime. They have alleged that Priya’s conduct “without a doubt, demonstrates that the alleged will has been fabricated.”
